6. License to UGC Maker AI

• By submitting User Content, you grant UGC Maker AI a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display such User Content for operating, improving, and promoting the Service.

7. Content Restrictions

• You agree not to upload, generate, or share User Content that: (a) Infringes on the intellectual property rights of others; (b) Violates any applicable laws or regulations; (c) Contains malware, viruses, or other harmful code; (d) Is misleading, false, or inaccurate.

8. Intellectual Property

• The Service is licensed, not sold. UGC Maker AI and its licensors retain all ownership and intellectual property rights in the Site, Service, and Content (software, text, graphics, logos, etc.). We reserve all rights not expressly granted in these Terms.

11. Billing

• Payments may be processed through third-party payment processors. By providing payment information, you authorize UGC Maker AI and its payment processors to charge the applicable fees to your payment method.

12. Premium Access and Credits

• Upon payment, you will receive one month of Premium Access, granting additional features and privileges within the Service. You will also receive 1 month of Credits, usable for specific functionalities or resources. Any new payment will automatically extend the duration of your Premium Access and Credits by the corresponding period associated with the new payment.

13. Refunds

• UGC Maker AI offers refunds within 3 days of the original subscription purchase, subject to the following conditions: (1) The refund request must be made within 3 days of purchase; (2) Usage must not exceed 10 AI image generations and 3 AI video generations; (3) Refunds will be reduced by the cost of credits already consumed and payment platform processing fees. Refunds will be processed within 7 business days through the original payment method.

14. Termination

• You may terminate your account at any time by following the instructions on the Site. Upon termination, your right to access and use the Service will cease immediately.

15. Termination by UGC Maker AI

• UGC Maker AI may terminate or suspend your account or access to the Service, with or without notice, for any reason, including violation of these Terms.

16. Effect of Termination

• Upon termination, all licenses granted to you under these Terms will terminate, and you must cease all use of the Service. Any accrued rights or obligations, including those related to payment and intellectual property, will survive termination.

17. Disclaimers and Limitation of Liability

• The Service is provided "as is" and "as available" without any warranties, express, implied, or statutory. UGC Maker AI does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by law, UGC Maker AI disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

18. Limitation of Liability

• To the maximum extent permitted by law, UGC Maker AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.
